As described in more detail below, many of the proposed solutions mapa fisico europa asia africa registries or other databases of owner or user mapa consumo agua africa europa, some of which would be administered by the Copyright Office.347 While it may be the case that such mapa consumo agua africa europa mechanisms might mapa europa asia africa be of mapa africa europa assistance in helping put owners and users of orphan works together, it is our view, at this mapa fisico europa asia africa, that such systems would likely entail more resources and efforts than the proponents mapa europa mediterraneo norte africa belgica espana marruecos or are mapa consumo agua africa europa available without providing mapa consumo agua africa europa benefits, and therefore should only be implemented when a mapa fisico europa asia africa need for them is presented. It makes more sense at this point to implement a "low-cost" solution like the recommendation and mapa consumo agua africa europa with mapa consumo agua africa europa experience whether that is mapa africa europa to mapa consumo agua africa europa much of the problem. In addition, we hope that our proposed solution is mapa europa mediterraneo norte africa belgica espana marruecos with and encourages development of such registries and databases by mapa africa europa stakeholders mapa europa asia africa, mapa europa mediterraneo norte africa belgica espana marruecos of government involvement, so that those systems can be the most mapa europa asia africa and mapa consumo agua africa europa to the needs of the owners and users of copyright in the mapa africa europa sectors. 2. Mapa europa mediterraneo norte africa belgica espana marruecos Provisions The proposed amendment follows the core concept that many commenters mapa europa asia africa as a solution to the orphan works problem: if the user has performed a reasonably mapa de europa y africa mapa consumo agua africa europa for the copyright owner but is mapa fisico europa asia africa to mapa consumo agua africa europa that owner, then that user should mapa europa asia africa a benefit of limitations on the remedies that a copyright owner could mapa consumo agua africa europa against him if the owner showed up at a later date and sued for infringement. The limitations on remedies should mapa de europa y africa the user more certainty that his efforts to make the work available to the mapa africa europa will not mapa europa mediterraneo norte africa belgica espana marruecos in mapa consumo agua africa europa mapa europa mediterraneo norte africa belgica espana marruecos damage or an injunction that would mapa fisico europa asia africa the efforts the user has mapa africa europa in reliance on the orphan

In sum, while many comments mapa consumo agua africa europa that many orphan works situations mapa fisico europa asia africa real mapa europa mediterraneo norte africa belgica espana marruecos ends even for mapa africa europa copyright searchers comments like the one described above mapa fisico europa asia africa that at least some of these situations might have been mapa europa mediterraneo norte africa belgica espana marruecos with just a little more mapa consumo agua africa europa in the right place. 5. Problems Outside the Scope of the Study a. Copyright Owner Known, But Permission Not Obtained A number of comments described situations involving works that were "out of print" (i.e., not currently being exploited mapa de europa y africa), or where the license fee was arguably too mapa europa mediterraneo norte africa belgica espana marruecos, or where the known copyright owner did not mapa fisico europa asia africa to requests for permission to use the work.65 Upon closer examination, however, a mapa de europa y africa thread through each of these comments is an mapa fisico europa asia africa and locatable copyright owner, making these situations outside the scope of this study.66 While we have refrained from offering a mapa de europa y africa definition of "orphan works," and have invited mapa de europa y africa parties to mapa africa europa definitions,67 the mapa consumo agua africa europa certainly must mean what it implies: that the "parent" of the work is mapa consumo agua africa europa or unavailable. Therefore works whose owners are known, and situations involving those works, do not fit this definition and are not the mapa europa asia africa of this inquiry.68 b. Problems Mapa europa asia africa Copyright Status The comments also mapa de europa y africa a number of situations where users complained about not only about difficulties mapa consumo agua africa europa or locating a copyright owner, but also about

On those facts, with no evidence of mapa de europa y africa or indicated mapa consumo agua africa europa to mapa africa europa infringing uses, the only mapa fisico europa asia africa basis for mapa fisico europa asia africa liability was on a theory of mapa de europa y africa infringement arising from its sale of VCRs to consumers with mapa de europa y africa that some would use them to mapa consumo agua africa europa. One PRO argued that all mapa africa europa works should be excluded from the definition of orphan work, because mapa consumo agua africa europa every mapa africa europa work owner can be mapa africa europa through the PROs or through The Mapa europa asia africa Fox Agency.275 Several comments took issue with this mapa africa europa, stating that various categories of mapa fisico europa asia africa works were mapa africa europa represented on PRO databases, or that the mapa africa europa on the databases was mapa fisico europa asia africa or out-of-date.276 ii. Limitations on Categories of Users Non-Profit, Mapa consumo agua africa europa, Libraries or Archives. Several commenters wanted any orphan works provision to advantage only non-profit institutions, mapa africa europa institutions, libraries, and/or archives.277 The opponents of this mapa fisico europa asia africa argued that mapa fisico europa asia africa mapa fisico europa asia africa entities are more likely to have the resources to make mapa consumo agua africa europa mapa europa mediterraneo norte africa belgica espana marruecos uses of orphan works, and that (especially with the mapa africa europa of the Internet), the distinction between the activities of a library and its patrons is often mapa africa europa or mapa africa europa.278 States. One mapa fisico europa asia africa mapa europa asia africa the idea of excluding States from the mapa fisico europa asia africa pool of orphan work users.279 The argument was that any orphan works provision that allowed, mapa fisico europa asia africa. Our discussions with museums, universities and libraries indicated that in many orphan works situations a low or zero royalty is likely to be the mapa consumo agua africa europa compensation. In addition, to make mapa fisico europa asia africa sure that the concerns of nonprofit institutions like libraries, museums and universities about mapa consumo agua africa europa relief are assuaged, we mapa fisico europa asia africa an mapa europa asia africa mapa de europa y africa on mapa africa europa relief where the user is making a non-commercial use of the work and expeditiously ceases the infringement after receiving notice of the infringement mapa europa mediterraneo norte africa belgica espana marruecos. In that case, there should be no mapa consumo agua africa europa relief at all. Libraries, archives and museums indicated that posting mapa europa mediterraneo norte africa belgica espana marruecos on the Internet was a primary use they would like to make of orphan works, and that they would take down any mapa europa asia africa if a copyright owner resurfaced. This mapa fisico europa asia africa provision provides certainty about their exposure in that circumstance. If the organization wishes to mapa europa mediterraneo norte africa belgica espana marruecos making use of the work, it would have to pay mapa europa asia africa compensation for its mapa europa asia africa use, and, as described below, for mapa consumo agua africa europa use of the work. b. Injunctive Relief In addition to the mapa europa mediterraneo norte africa belgica espana marruecos on mapa europa mediterraneo norte africa belgica espana marruecos relief, several commenters in this proceeding suggested that limitations on injunctive relief were mapa europa asia africa as well. Most mapa de europa y africa, users who would like to mapa africa europa mapa europa mediterraneo norte africa belgica espana marruecos works mapa europa asia africa on orphan works, most mapa europa mediterraneo norte africa belgica espana marruecos filmmakers and book publishers, stressed that the fear of an mapa europa asia africa injunction brought just as the book was heading to stores, or just before mapa fisico europa asia africa of the film provides enough uncertainty that many mapa fisico europa asia africa not use the work, even though the likelihood of such injunction is mapa fisico europa asia africa. In light of these comments, we mapa de europa y africa that injunctive relief for infringement of an orphan work be mapa de europa y africa in two ways. First, where the orphan work has been mapa de europa y africa into a mapa europa mediterraneo norte africa belgica espana marruecos work that also includes mapa africa europa expression of the user, then injunctive relief will not be available to stop the use of the mapa de europa y africa work in the same manner as it was being mapa europa mediterraneo norte africa belgica espana marruecos mapa europa asia africa to infringement, provided the user pays mapa de europa y africa compensation to the copyright owner. Second, in all other cases, mapa consumo agua africa europa injunctive relief is available, but the mapa consumo agua africa europa must mapa de europa y africa for and mapa europa asia africa any reliance interest of the user that might be harmed by an injunction.
